Florida man says he’s too morbidly obese for prison

A judge is accusing a Florida man of stalling in the wake of his conviction for a multimillion dollar mortgage fraud scheme in Seminole County, Orlando’s WESH-TV reports.

James Olivos’ excuse? He’s too morbidly obese to begin serving his five-year prison sentence.

The 47-year-old also complained of coughing up blood, foot pains and ADHD. Judge Karla Spaulding was not amused.

“I don’t see anything that confirms these complaints,” Spaulding said.

In December 2013, Olivos was sentenced to a five-year prison term and a $2.8 million fine. The only reason he has not been jailed is because Spaulding is not the judge who sentenced him.

He has 48 hours to produce evidence of his complaints.
